What is the process of mediation?

Mediation is a process where a neutral third party, the mediator, plays a crucial role in facilitating negotiation and communication between two disputing parties. Their goal is to guide the parties towards a mutually acceptable agreement. This process is often required when parties are unable to reach an agreement and have irreconcilable differences in divorce proceedings involving financial matters and minor children.

Mediation is a cost-effective alternative to legal representation. When the process is handled through legal representation for both parties, it can become expensive due to endless correspondence between the legal teams. In a worst-case scenario, the parties may not reach an agreement, leading to a court decision that both parties may be unsatisfied with. In contrast, mediation is far less costly, more convenient, and more amicable. A mediator can help both parties air their concerns and reach an agreement, saving time and money.

What is the role of the psychologist/mediator?

A psychologist, a professional with training in mediation, plays a crucial role in formulating an outcome in which all involved are satisfied with the decisions made and the agreement reached. The mediator is tasked with the need to determine the interests, needs and wishes of both parties. He also takes into consideration their rights and legal obligations. With precise timing and careful probing, he may discover common ground that can coax the parties into an acceptable arrangement. The agreement may then be converted into a legal document by attorneys representing each party and, in certain cases, made into a court order.
